Monthly treasury report was approved.
The Alternate Energy Section of the local Ordinance is being updated, with participation by the planning commission. The 300 foot set-back provision is being changed to 100 feet. Resolution #2024-06 to plan for Alternate Energy was passed. The Motion was carried. The Public Hearing on this matter is scheduled for April 22, 2024.
Damascus Township Board of Supervisors will hold a PUBLIC HEARING on MONDAY, APRIL 22, 2024, AT 6:00 P.M. at the Damascus Township Municipal Building, 60 Conklin Hill Road, Damascus, PA. for the purpose of receiving Public Input on a Proposed Zoning Ordinance Amendment for the Alternative Energy Section. (1)
In the related matter of the dispute between Attorney Malak representing Tyler Hill Solar LLC vs Damascus Township Board of Supervisors, the Settlement/Stipulation issued by the Court Of Common Pleas was discussed.
Just to summarize briefly, the application to the township by the Tyler Hill Solar LLC was previously denied. The application was incomplete, lacking several sections, lacking the drainage plan, or storm water management plan, required of any new structures, and lacking Certification Of Feasibility or letter from each utility company that services the property, noting that the company is aware of the construction site. (As previously reported in The River Reporter, the Damascus Township Subdivision and Land Development Ordinance lays out the informational requirements that should be in an application for this type of project. Key information needed on the application would include the Storm Water Management Plan which would summarize how runoff and storm water are to be handled, on the property and the plan for handling erosion and sentiment issues. A plan to minimize the environmental degradation that may result from an excess of water. These can be typically addressed by the inclusion of a letter or memo from the Wayne County Conservation District.) (2)
The subsequent filing in the Court of Common Pleas was made by the law firm of Chariton and Malak. We asked Chariton and Malak L.L.C. for clarification. We have received no reply.
It was stated that the Court of Common Pleas of Wayne County Pa has issued a Settlement , Stipulation under citation # 608-4es. (Docket # 425 cv 2023). In discussion at this meeting it was stated that the stipulation, if signed by both parties would end the lawsuit problem and that the application, if received in full and deemed complete, with the pending certification of feasibility by the utility company included, will be accepted.

The motion to sign the stipulation agreement carried, motion was passed. The appropriate request has been made for the Stipulation/ Settlement document under the Freedom of Information Act.

Road Crew Worker to be hired.
There will be a special meeting March 25 at 7:00 a.m.

Update on Darby Hotel violation

The fine was paid and the permit was obtained.
Native grasses are being tested at the Milanville Ranger Station.

Pete Casazza, local school teacher, thanked the board for their years of service and noted the importance of local government in our lives.
Local Constable Christopher Lee spoke about his position and the ongoing campaign of information surrounding the work of constables in Pennsylvania. They do make arrests for on-view misdemeanors and felonies, as well as breaches of the peace, and they enforce ordinances. It is an elected position in Pa. and they are responsible to the voters. The Pennsylvania Fraternal Order of Constables would like to reinforce their position and correct some misconceptions. Constables, for example, although they operate independently of the municipal governments, are not “Independent Contractors”. Constables are peace officers, and as such are known officers charged with conservation of the peace. Peace officers, in other words. The misconception exists that constables are “impersonating an officer”. They are however, included in the statutory reference (definition) Title 3, section 459-102, as being within the definition of a police officer. Assaulting a Law Enforcement Officer, a punishable offense in Pa and elsewhere, and the definition extends to constables as well as other uniformed officers.

There are those who believe that Constables are untrained and are not supposed to carry firearms, but the exemption from obtaining a license applies to them and constables receive training and certification through the Pennsylvania Commission on Crime and Delinquency, including the Basic Forearms Course, the Annual Firearms Qualification Course and the optional Annual Continuing Education.
Damascus Manor Community Center Events
Recycle Saturdays- The last recycle Saturday was held on March 9 and was successful. The program continues (May to September).
Game Day - the last of the scheduled Game Days for the season was March 10, and was attend by 12 to 15 people, who played board games.
Game day is held on selected Sundays in winter months. Everyone is welcome to come and play Indoor board games in winter months. Kids welcome.
Annual DMCC Pancake Breakfast was held 3 /16 /2024
The NEPA Maple Producers Association were highlighted, and the event was a success. N.E.P.A. Maple Producers Association had a series of events that same weekend, See River Reporter March 12 (4) footnotes
Discussion and Approvals of Subdivisions
Two parcels of land in the property of J.L., Beach Lake Highway/Milanville Rd., to be subdivided, in order to satisfy the last will and testament for the heirs. This was approved.
Add a second home to a local property. Single property, single driveway. This was approved also.
